On 2 September 2026, the High Court Division imposed an eight-week injunction halting all activities related to the construction of a 1.6-kilometre road by Cox’s Bazar Municipality within the Ecologically Critical Area (ECA), No-Development Zone, and protected tourism area of Cox’s Bazar Sea Beach. Alongside the injunction, the Hon’ble Court also issued a Rule upon the respondents.
Through the Rule, the Court has asked why the construction of the said road by Cox’s Bazar Municipality, as well as the failure of the concerned authorities to prevent such construction, should not be declared to be without lawful authority, contrary to public interest, irregular, and illegal, being inconsistent with the Constitution and the laws in force in Bangladesh. The Court also sought to know why directions should not be issued to remove the portions of the road already constructed and restore the sea beach and its biodiversity.
The order was issued following the preliminary hearing of a public interest litigation (Case No. 12294/2026) filed by the Bangladesh Environmental Lawyers Association (BELA) seeking to protect Cox’s Bazar Sea Beach and prevent further degradation of its ecosystem.
The road is being constructed within the Ecologically Critical Area and No-Development Zone, extending from Sugandha Point of Cox’s Bazar Sea Beach to Hotel Simon. The approximately 1.6-kilometre road is being constructed under the “Urban Development and Urban Governance Project” with funding from JICA. When construction began after a large area of the beach was filled for the project, experts and environmentalists raised strong objections.
For the construction of the road, years-old sand dunes, recognised as one of the coast’s important natural protective barriers, were indiscriminately demolished using excavators. Vegetation essential to the beach ecosystem, including beach morning glory (Sagar Lata), as well as habitats of red crabs and other marine biodiversity, has also been destroyed.
Previously, the Supreme Court of Bangladesh issued several judgments and orders directing the authorities to refrain from constructing structures within the Ecologically Critical Area of the sea beach and to remove illegally constructed structures. Despite these clear directives, Cox’s Bazar Municipality proceeded with road construction through the sea beach.
Against this backdrop, BELA filed the present public interest litigation to protect Cox’s Bazar, the world’s longest natural sea beach, and prevent further destruction of its ecosystem.
The respondents in the case are: the Secretary, Ministry of Environment, Forest and Climate Change; the Secretary, Local Government Division, Ministry of Local Government, Rural Development and Co-operatives; the Secretary, Ministry of Housing and Public Works; the Secretary, Ministry of Civil Aviation and Tourism; the Chairman, Cox’s Bazar Development Authority; the Director General, Department of Environment; the Deputy Commissioner and Superintendent of Police of Cox’s Bazar; the Administrator of Cox’s Bazar Municipality; the Director of the District Office of the Department of Environment; and the General Manager of National Development Engineers (NDE) Ltd.
The order was passed by the Division Bench comprising Hon’ble Justice J. B. M. Hassan and Hon’ble Justice Aziz Ahmed Bhuiyan.
The case was conducted on behalf of BELA by Advocate Minhajul Haque Chowdhury, assisted by Advocate Hasanul Banna and Advocate Rumana Sharmin (Barrister-at-Law). Attorney General Ruhul Quddus Kazal appeared for the Government.
কক্সবাজার সমুদ্র সৈকতের প্রতিবেশগত সংকটাপন্ন এলাকায় রাস্তা নির্মাণে হাইকোর্টের নিষেধাজ্ঞা
০২ সেপ্টেম্বর, ২০২৬ কক্সবাজার সমুদ্র সৈকতের প্রতিবেশগত সংকটাপন্ন এলাকায় (ইসিএ), নো ডেভেলপমেন্ট জোনে এবং সংরক্ষিত পর্যটন এলাকায় কক্সবাজার পৌরসভা কর্তৃক ১.৬ কিলোমিটার রাস্তা নির্মাণের সকল কার্যক্রমের উপর ৮ সপ্তাহের নিষেধাজ্ঞা আরোপ করেছেন মহামান্য হাইকোর্ট বিভাগ। নিষেধাজ্ঞা আরোপের পাশাপাশি বিবাদীগণের উপর রুলও জারি করেছেন মহামান্য হাইকোর্ট বিভাগ। জারিকৃত এ রুলে সমুদ্র কক্সবাজার পৌরসভা কর্তৃক উল্লেখিত রাস্তা নির্মাণ এবং তা প্রতিরোধে অন্যান্য সংশ্লিষ্ট কর্তৃপক্ষের ব্যর্থতা সংবিধান ও দেশে প্রচলিত আইনের পরিপন্থি হওয়ায় কেন তা আইনি কর্তৃত্ববিহীন, জনস্বার্থবিরোধী, বিধিবর্হিভূত এবং বেআইনি ঘোষণা করা হবে না তা জানতে চেয়েছেন মহামান্য আদালত। একইসাথে ইতোমধ্যে নির্মিত উল্লেখিত রাস্তার অংশবিশেষ অপসারণপূর্বক সমুদ্র সৈকত ও এর জীববৈচিত্র্য পুনরুদ্ধারের নির্দেশ কেন প্রদান করা হবে না তাও জানতে চেয়েছেন আদালত।
বাংলাদেশ পরিবেশ আইনবিদ সমিতি (বেলা) কর্তৃক দায়েরকৃত এক জনস্বার্থমূলক মামলার (নং— ১২২৯৪/২০২৬) প্রাথমিক শুনানি শেষে জনাব বিচারপতি জে বি এম হাসান ও জনাব বিচারপতি আজিজ আহমেদ ভুঁইয়া এর সমন্বয়ে গঠিত মহামান্য হাইকোর্ট বিভাগের ডিভিশন বেঞ্চ উক্ত আদেশ ও রুলটি জারি করেন।
উল্লেখ্য, কক্সবাজার সমুদ্র সৈকতের সুগন্ধা পয়েন্ট থেকে হোটেল সায়মন পর্যন্ত প্রতিবেশগত সংকটাপন্ন এলাকায় ও নো ডেভেলপমেন্ট জোন’ এ কক্সবাজার পৌরসভা একটি সড়ক নির্মাণ করছে। ‘নগর উন্নয়ন ও নগর শাসন প্রকল্প’—এর আওতায় জাইকার অর্থায়নে সৈকতের বিশাল এলাকা ভরাট করে প্রায় ১.৬ কিলোমিটার দীর্ঘ এ সড়ক নির্মাণ কাজ শুরু হলে বিশেষজ্ঞ ও পরিবেশবাদীগণ এর প্রতিবাদ করেন। এ সড়ক নির্মাণের জন্য উপকূল সুরক্ষার অন্যতম প্রাকৃতিক ঢাল হিসেবে পরিচিত বহু বছরের বালিয়াড়ি নির্বিচারে এক্সকাভেটর দিয়ে গুঁড়িয়ে দেওয়া হয়েছে, ধ্বংস করা হয়েছে সৈকতের পরিবেশের জন্য অপরিহার্য উদ্ভিদ সাগরলতাসহ লাল কাঁকড়া ও সামুদ্রিক জীববৈচিত্র্যের আবাসস্থল।
ইতিপূর্বে সমুদ্র সৈকতের প্রতিবেশগত সংকটাপন্ন এলাকায় স্থাপনা নির্মাণ থেকে বিরত থাকতে এবং নির্মিত অবৈধ স্থাপনা উচ্ছেদে মহামান্য সুপ্রিম কোর্ট একাধিক রায় ও আদেশ প্রদান করেছেন। সর্বোচ্চ আদালতের সুস্পষ্ট আদেশ অমান্য করে কক্সবাজার পৌরসভা কর্তৃক সৈকতের বুক চিরে সড়ক নির্মাণের বিরুদ্ধে এবং বিশ্বের দীর্ঘতম সমুদ্র সৈকত সকল রক্ষায় বেলা জনস্বার্থে উল্লেখিত মামলাটি দায়ের করে।
মামলার বিবাদীগণ হলেন— পরিবেশ, বন ও জলবায়ু পরিবর্তন মন্ত্রণালয়ের সচিব; স্থানীয় সরকার বিভাগ, স্থানীয় সরকার, পল্লী উন্নয়ন ও সমবায় মন্ত্রণালয়ের সচিব; গৃহায়ন ও গণপূর্ত মন্ত্রণালয়ের সচিব; বেসাময়িক বিমান পরিবহন ও পর্যটন মন্ত্রণালয়ের সচিব; কক্সবাজার উন্নয়ন কর্তৃপক্ষের চেয়ারম্যান, পরিবেশ অধিদপ্তরের মহাপরিচালক; কক্সবাজরের জেলা প্রশাসক ও পুলিশ সুপার; কক্সবাজার পৌরসভার প্রশাসক; পরিবেশ অধিদপ্তরের জেলা কার্যালয় পরিচালক, এবং ন্যাশনাল ডেভেলপমেন্ট ইঞ্জিনিয়ার্স (এনডিই) লি: এর জেনারেল ম্যানেজার।
বাংলাদেশ পরিবেশ আইনবিদ সমিতি (বেলা)—এর পক্ষে মামলাটি পরিচালনা করেন এডভোকেট মিনহাজুল হক চৌধুরী এবং তাঁকে সহায়তা করেন এডভোকেট হাসানুল বান্না ও এডভোকেট রুমানা শারমিন (বার—এট—ল)। সরকার পক্ষে ছিলেন মাননীয় এটর্নী জেনারেল রুহুল কুদ্দুস কাজল।
